These Terms of Service (the "Agreement") are an agreement between Cyber Cast International, S.A. ("MailRush.io" or "us" or "our") and you ("User" or "you" or "your" or "Customer"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by Cyber Cast International, S.A. and of the MailRush.io website (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services. Cyber Cast International, S.A. reserves the right to make changes to the provided Agreement as needed, without notice to our clients. Modification made to the terms does not constitute early contract termination or non-payment.
Applied Law: The present Agreement is subject to the law of the Republic of Panama. The Service and any data you provide to Cyber Cast International, S.A. is subject to the law of the Republic of Panama.
Delivery & Filtering Policy: MailRush.io will use reasonable efforts to deliver your email messages, but MailRush.io does not guarantee delivery. Spam filters and other policies of recipient email services may prevent successful delivery of your messages. MailRush.io does not provide antivirus or spam filters for inbound emails so the Customer should take apropiate actions to prevent any unwanted situation. MailRush.io is not responsible for any damages arising from using MailRush.io services.
Intended Usage: The client understand that MailRush.io can be used only for B2B email outreach. B2C email aoutreach is not supported.
Account Warm-up Process: MailRush.io will limit the number of emails you can send during early stage of the account. As the account ages the limit will be increased up to the limit of the plan. The process takes 90 days to be completed.
Anti-Abuse: MailRush.io will limit access to providers that have responded with a negative alert in regards to your campaigns. MailRush.io will set a temporary restriction to send email to the affected provider, that can range between 1 hour up to 30 days depending on the impact of the case.
Support Policy: Cyber Cast International, S.A. is committed to offer First Level technical support to all our service 24 hours via ticket system opened at Billing Panel (Clients Portal) and via Live Chat at our Website https://mailrush.io. Customer should open a support ticket before issuing a support phone call. Initial ticket respond is 1 hour and further communication may take longer depending on ticket difficulty or conditions.
Termination and Suspension Policy: Any payment not received within four (4) days of the invoice due date, Cyber Cast International, S.A. reserved the right to suspend the account without any notice. Once suspended the Customer will not be able to connect to the SMTP relay or API serivce. If after fifteen (15) days of not receiving a payment confirmation Cyber Cast International, S.A. reserved the right to terminate the account without any further notice. At this point any data, email, files stored in our servers will be deleted.
Customer Obligations: Customer represents and warrants that is at least eighteen (18) years of age. Customer possesses the legal right and ability to enter into this Agreement, and the performance of its obligations and use of the Services (by Customer, its customers and users) will not violate any applicable laws or regulations or cause a breach of the Agreement. Customer assumes all risks related to processing of transactions related to electronic commerce.
Refund Policy: MailRush.io do not offer refund for any of its service. MailRush.io offers a free trial with all Mailrush.io features enable for our users to test before placing a paid order. Any payment or prepayment is a commitment regarding the payment period that cannot be refunded. Any available credit in the Customer account cannot be refunded but may be used to pay new services or pending invoices. Billing errors can be credited to your MailRush.io account retroactively for a period of up to two (2) months.
Disclaimer of Actions Caused by and/or Under the Control of Third Parties: Cyber Cast International, S.A. does not and cannot control the flow of information to or from Cyber Cast International, S.A. network and other portions of the Internet. Such flow depends in large part on the performance of Internet services provided or controlled by third parties. At times, actions or inactions of such third parties can impair or disrupt customer's connections to the Internet (or portions thereof). Cyber Cast International, S.A. cannot guarantee that such events will not occur. Accordingly Cyber Cast International, S.A. disclaims any and all liability resulting from or related to such events.
No Other Warranty: The Services are provided on an 'as is' basis, and Customer's use of the services at its own risk. Cyber Cast International, S.A. does not make, and hereby disclaims, any and all other express and/or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement and title, and any warranties arising from a course of dealing, usage or trade practice. Cyber Cast International, S.A. does not warrant that the services will be uninterrupted, error-free or completely secure.
Transfer of the Agreement: The Client agrees that he shall not transfer the Agreement or any right derived from the access and use of the Service to a third party.
Terms of Services Changes We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
